TERMS AND CONDITIONS
THE LEGAL AGREEMENTS SET FORTH BELOW GOVERNS YOUR USE OF ALL FREEDCAMP, INC. SERVICES. IF YOU AGREE TO THESE TERMS, CLICK "AGREE." IF YOU DO NOT AGREE TO THESE TERMS, DO NOT CLICK "AGREE," AND DO NOT USE THE SERVICES.
Terms Of Sales
FREEDCAMP, INC. accepts these forms of payment: all valid Credit/Debit cards and/or payments through a PayPal account. Freedcamp will generally accept PayPal and/or wire payments only at User`s request for yearly payments; please contact Freedcamp directly if this is your payment method of choice. If a credit card or PayPal account is being used for a transaction, Freedcamp may obtain preapproval for an amount up to the amount of your order. No amount will be charged until Freedcamp validates your payment information. All payments made will be charged in US dollars.
Applications Sales
Free Trial
All first time Application(s) purchases are given, starting with the day of purchase, to test the Application(s)
- Have a registered account;
- Must be the first time subscribing to the free trial. If User have already previously completed a previous trial, there will not be an additional trial period;
- Not already be paying for the subscription either monthly or annually.
Once the trial period has ended, Users have the option of purchasing the monthly subscription (b) or annual subscription (c).
Monthly Subscription
User will have the option of subscribing to their Application on a monthly basis post trial period by clicking on the monthly option and the “Subscribe Now” tab on the Application page. A valid Credit Card and Billing information is required to complete the purchase. All payments will be charged in US Dollars. By subscribing to the Monthly Subscription, Users are authorizing Freedcamp to charge their Credit Card, in advance, on the first day of subscription and on a monthly recurring basis.
Ex. 1
A user first subscribes to Invoice+ ($6.99) for the first time on 3/1/2015 and is given a 14-day trial. User then elects to purchase the Monthly Subscription plan on 3/15/2015. User will be billed $6.99 on 3/15/2015 and then again the following month on 4/15/2015 and then on 5/15/2015, etc.
Annual Subscription
Instead of Monthly Subscription, users also have the option to elect the Annual Subscription plan on the Application page as well. Application plans comes with a 5% discount as compared to paying monthly. A valid Credit Card and Billing information is required to complete the purchase. All payments will be charged in US Dollars. By subscribing to the Annual Subscription, Users are authorizing Freedcamp to charge your Credit Card, in advance, on the first day of subscription and again on an annual basis.
Ex. 2
A user first subscribes to Invoice+ ($6.99) for the first time on 3/1/2015 and is given a 14-day trial. User then elects to purchase the Annual Subscription plan on 3/15/2015. User will be billed $79.00 on 3/15/2015 and then again on 3/15/2016, 3/15/2017, etc.
User may uninstall the Application during the 14-trial without being charge. No refund will be given once user has paid for an application unless the Application(s) has a significant error. Please see our Refund Policy for further information. Multiple Applications purchased on the same day will be billed together.
If User has decided to uninstall a paid or trial Application and then renew it later on, there will be no subsequent or additional trial period. Trial periods are only for first time purchases. Renewed subscription(s) will be billed on first day of purchase and then automatically billed again on a recurring monthly or annual basis. Freedcamp will only store saved information on uninstall Application up to 60 days. It is the user`s responsibility to renew their Applications before 60-day period in order to retrieve all stored data.
Storage Sales
There are two ways in which Users may upgrade or purchase additional storage by:
- Clicking on the drop down menu located at the top right corner of the header. There will be an option to choose “Storage Updates” which will take Users to the Manage Storage page.
- If Users are in the Marketplace, Users may click the “Upgrade Storage” tab on the top right corner which will also take Users to the Manage Storage page.
Freedcamp offers 5 level of paid Storage Plans: Basic 1.00GB, More 5.00GB, Plus 10.00GB, Premium 15.00GB, and Unlimited. Each plan will have a monthly or yearly subscription plan. Users will be billed for storage immediately upon purchase and will be billed again on the same date for all following months or year. If users first purchased a Basic Plan($2.49/GB) and decided to upgrade to a More Plan($7.99/GB), users will be billed the prorated amount for the More plan. The prorated amount is determined by difference in price and remaining time before the next billing date. Upon receipt of payment, user will immediately see an increase in their storage capacity. Users will then be billed the new Storage Plan amount on the next billing date. If users decides to downgrade from a More Plan to a Basic Plan, users will be automatically refunded the prorated amount. The storage amount will be immediately reduced and user will be billed the new lower Storage Plan price on the next billing date. Users may not mix or combine different Storage Plans. Freedcamp only offers fixed storage updates, therefore Users will have to choose one specific plan.
You agree to pay for all products purchased through Freedcamp`s Marketplace. Freedcamp, may charge your account automatically every month or year for the continual use of the application and/or storage plans. Any nonpayment by the User will result in the expiration and unavailability of application(s) until payment resumes. (Please see Freedcamp`s Rights for further detail regarding nonpayment). YOU ARE RESPONSIBLE FOR THE TIMELY PAYMENT OF ALL FEES AND FOR PROVIDING FREEDCAMP WITH A VALID CREDIT/DEBIT CARD OR PAYPAL ACCOUNT DETAILS FOR PAYMENT OF ALL FEES. All monthly fees will be billed to the credit/debit card account Users designated during the registration process. Users may make updates to their payment information by choosing “My Account” under the drop down menu in the top right corner and then choose the “billing” option. It is Users` responsibility to stop the monthly payments if you no longer wish to subscribe to the Applications and/or Storage plans. You may contact Freedcamp through our Contact Links regarding any payment changes.
Your total price will be the cost of the applications, plus any applicable fees and sales tax. We will only charge sales tax in states where digital goods are taxable.
Refund and Cancelation Policy
Freedcamp will not offer a full refund unless major problems and bugs exist within our applications and are not fixed in a timely manner. It is Users` responsibility to inform Freedcamp of any application errors. User may submit a request for refund by stating out the appropriate grounds for a refund. Freedcamp will consider each individual refund request but is not obligated to grant User(s) a refund just based on the submission of a request. YOU MAY NOT REQUEST A REFUND IF YOU HAVE ALREADY USED THE APPLICATIONS FOR OVER 2 WEEKS AFTER MAKING PAYMENT. Freedcamp does not offer refunds for storage payments.
Freedcamp`s billing system requires Users to pay for the Application and Storage in advance and therefore User must cancel the Application Subscription(s) before the next billing cycle date in order to avoid the automatic recurring charges. If user cancels subscription at any time before the next billing cycle, user will still be able to use the Application until the next billing cycle date. See example below for further information.
Ex. 3
User first purchases a Google drive Application for $2.99 on 9/1/2015. User is first given a 14-day trial period and then purchased a monthly subscription on 9/15/2015. User will be first charged $2.99 on 9/15/2015 and then again on 10/15/2015. If, however, User cancels subscription on 10/9/2015, user will not be billed on 10/15/2015 and User will still have access to the Application until 10/15/2015. No refund will be granted unless the Application`s error is due to Freedcamp.
Freedcamp`s Rights
Freedcamp, INC. reserves the right to:
- Close accounts and request alternative forms of payments if current forms of payment is fraudulently obtained or used on Freedcamp`s Marketplace.
- Cancel any transaction if we believe the transaction violates the Terms of Sales, or we believe doing so may prevent financial loss.
If billing error occurs, on date of billing, due to: a) Credit/Debit card decline, b) misrepresented financial information, or c) User Negligence, then User will be immediately notified via email of payment error on date of billing. User will then have 24 hours to make payment. To update billing information please visit Billing Tab on the My Account page.Freedcamp reserves the right to stop all functionality of any unpaid Application until payment is received. Any stored Application data will be saved for 60 days after the expiration period. If User eventually resumes payment within those 60 days, all saved Application data will be restored. If no payment is received during the 60 day, all Application data will be deleted. It is the User`s responsibility to meet all financial obligations and make prompt payments within the set time period. Late payment made during the 24 hour time limit will not alter the billing date for the following months. Renewed subscription payments made after an Application has been suspended will set a new billing date and User will be automatically billed on the new payment date for all following months. Please see examples below.
Ex. 4.
User first purchases a $12.99 CRM Application on 7/1/2015. User is given a 14-day trial period and then purchased monthly subscription on 7/15/2015. The next billing date will occur on 8/15/2015. If no payment is made on 8/15/2014, User will immediately receive an email regarding the payment error. User will be given 24 hours to make the proper payments. If User finally makes a payment on 8/16/2014, User will still be able to use the Application and will be billed again on 9/15/2015.
If User fails to make payment within the 24 hour period, Freedcamp will stop all functionality of the Application until payment is received. If User eventually pays on 9/25/2015, Freedcamp will resume the functionality of the Application and the next billing date will now be on 10/25/2015 instead.
In addition, Freedcamp also reserves the right to:
- Make any inquiries that we consider necessary, either directly or through third parties, regarding User identities and creditworthiness.
- Start charging for any free Applications or make any previously paid Application free. No refunds will be issued as a result from these changes.
Electronic Contracting
Your use of Freedcamp`s Marketplace includes the ability to enter into agreements and/or to make transactions electronically. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS. YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO ON THIS SITE, INCLUDING NOTICES OF CANCELLATION, POLICIES, CONTRACTS, AND APPLICATIONS. It is your responsibility to have all appropriate hardware and software that allows you access to your electronic records. If you are under the age of 18, you may only make payments with the approval of a parent or guardian. We request that you review the Terms of Sales with your parents or guardian.

THIS LEGAL AGREEMENT BETWEEN YOU, the USER, AND FREEDCAMP, INC. GOVERNS YOUR USE OF FREEDCAMP, INC. and the FREEDCAMP MARKETPLACE.
Freedcamp
Freedcamp is the provider of a free Project Management System that permits you to collaborate, communicate and operate your projects with your team members on our platform.
Requirements For Use
Freedcamp is available for individuals aged 13 and older. If you are below the age of 13, please review this Agreement with your parents or legal guardians before using Freedcamp.
The use of Freedcamp requires a compatible device, internet access, and compatible software. Your ability to use Freedcamp and the performance of our service may be affected by these factors. Such system requirements are your sole responsibility.
Your Account
As a registered User of Freedcamp, you may create an Account. Do not share your Account information to anyone else, less you do so at your own risk. You are solely responsible for maintaining the confidentiality and security of your Account and all activities relating to your Account. If your account has been compromised, you agree to immediately notify Freecamp of your Account; failure to promptly notify Freedcamp of any security breach is at your own risk. Freedcamp will not be responsible for any losses arising out of the unauthorized use of your Account.
In order to use Freedcamp, you must enter your EMAIL and PASSWORD. Once you have authenticated your Account, you will have access to Freedcamp`s Project Management System platform and your applications(free or previously purchased). During this time, you will be able to use our collaboration system or purchase additional applications on our Marketplace. (See our Terms of Sales for further detail on purchasing Applications through Freedcamp.)
You agree to provide all accurate and complete information when registering an Account and you agree to update your Account to further reflect the accuracy and completeness of your information. You agree that Freedcamp may store and use the Account information you provided in maintaining and billing fees to your Account.
Your Contents And Information
You, the User, are responsible and own all content, information or uploaded files you post through Freedcamp, and you can control how your information is shared through Freedcamp. You specifically grant Freedcamp permission to share your content and information with other team members of your project groups. You acknowledge that this agreement will end when you delete your Account unless you shared your information with your team members, and they still own and operate their Account in your group. You understand that even after you deleted your Account, online data may still be stored in backup data for periods of time but will not be available to any third parties.
In addition to the above agreement you also agree not to: 1) use Freedcamp to conduct any unlawful or fraudulent activities, 2)upload any viruses and malicious code, 3)collect information from other Users in an unlawful matter, 4)harass or threaten other Users, 5)post hateful, threatening, pornographic content, violent, or any nudity or graphic contents, and 6)do anything that would threaten or damage the operation of Freedcamp`s online Project Management System.
Privacy
Freedcamp`s Privacy Policy applies to the use of Freedcamp`s Project Management System and the terms are made a part of these Terms and Conditions by this reference. Additionally, by using Freedcamp`s online Project Management System, you agree and acknowledge that the internet is never completely private and secure. You understand any information you post, upload and share with others Users through Freedcamp may be read or intercepted by others, even if there is a special notice that a particular data(ex. Credit card information) is encrypted. Please refer to Freedcamp`s Privacy Policy for further detail.
Indemnity
You agree to indemnify and hold Freedcamp, its officers, investors, successors in interest, employees, and associates harmless from any demands, loss, liabilities, claims or expenses(including attorneys` fees), made against Freedcamp by any third party due to or arising out of or in connection with your use of Freedcamp.
Amendments
Freedcamp holds the right to make changes to our Terms and Conditions without notice should we find it necessary to do so. Freedcamp may or may not notify User of changes, it is your responsibility to keep yourself updated with our Terms and Conditions.
Violation Of The Terms And Conditions
Freedcamp may disclose any information we have about you(including identity) if we find that such disclosure is necessary relating to any investigation or complaint regarding your use of Freedcamp`s online Project Management System, or to identify, contact and take legal action against someone who may be misusing or interfering with Freedcamp`s rights and property, or the rights or property of Users of this site. Freedcamp reserves the right at all times to disclose any information that Freedcamp deems necessary to comply with any applicable law, regulations, or Federal process. Freedcamp may also disclose your information when Freedcamp applicable laws requires or allows such disclosures, including conducting acts of fraudulent activities. You agree that Freedcamp may, at our discretion and without prior notice, terminate your access to our website and/or block your future access to Freedcamp if we determine that you have violated our Terms and Conditions. You also agree that Freedcmap may, at our discretion and without prior notice, terminate your access to Freedcamp for any cause including, but not limited to: 1) request by law officials or governmental agencies, 2)a request by you, self termination, and 3) unexpected technical difficulties or problems
If Freedcamp ever take legal action against you as a result of your violations of our Terms and Conditions, Freedcamp is entitled to recover from you all attorney fees and cost of legal action including any damages and fees incurred by Freedcamp. Freedcamp is not liable for you or any third party as a result of your Account termination due to your violation of our Terms and Conditions.
